Terms of Use

These Terms of Use ("Terms") govern your use of the Best Daily mobile application ("the App") provided by Compromiso ("we," "us," or "our"). By downloading, installing, or using Best Daily, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the App.

By using Best Daily, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We grant you a limited, non-exclusive, non-transferable, revocable license to use Best Daily for your personal, non-commercial purposes, subject to these Terms.

You may not:

• Distribute, sell, lease, or sublicense the App
• Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law
• Remove or modify any proprietary notices or labels in the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any portion of the App or its related systems

Best Daily is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that:

• The App will meet your requirements
• The App will be uninterrupted, timely, secure, or error-free
• Any defects in the App will be corrected
• The App is free from viruses or other harmful components

You use Best Daily at your own risk.

You are solely responsible for:

• The accuracy of the data you enter into the App
• Backing up your data if it is important to you (use the export feature when available)
• The security of your device, including lock screen, biometric setup, and access controls
• Compliance with any laws applicable to your use of the App

Best Daily stores your data locally on your device. If you uninstall the App, factory reset your device, or lose your device, your data may be permanently lost. We do not have copies of your data and cannot recover it.

To the maximum extent permitted by law, Compromiso and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Loss of goodwill or reputation
• Personal injury or emotional distress
• Costs of substitute services
• Failure to achieve personal goals or accountability targets

This limitation applies regardless of the legal theory under which damages are sought and regardless of whether we have been advised of the possibility of such damages.

We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of data or content, and continuous availability of the App.

Best Daily is a tool for personal reflection and accountability tracking. It is not a substitute for professional mental health, medical, financial, fitness, or other professional advice. If you are dealing with issues requiring professional support, please consult qualified professionals.

All intellectual property rights in Best Daily, including but not limited to the software code, design, branding, and content (excluding your personal data), are owned by Compromiso or our licensors. These rights are protected by copyright, trademark, and other applicable laws.

The "Best Daily" name, "Compromiso" name, and associated logos are trademarks of Compromiso.

Best Daily may use third-party libraries and services as disclosed in our Privacy Policy. We are not responsible for the practices of any third-party services. Your use of any third-party services is governed by their own terms and policies.

We reserve the right, at any time and without notice, to:

• Modify, suspend, or discontinue the App or any part of it
• Change features, functionality, or appearance
• Remove or restrict access to any data or content
• Update these Terms

We may revise these Terms from time to time. When we do, we will update the "Last Updated" date at the top of these Terms. The revised Terms will be posted at bestdailyapp.com/terms. For material changes, we will provide notice within the App.

Your continued use of the App after such changes constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, you must discontinue use of the App.

You may stop using Best Daily at any time by uninstalling the App.

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including breach of these Terms.

You agree to indemnify, defend, and hold harmless Compromiso and its developer from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

These Terms are governed by the laws of the United States and the State of Texas, without regard to its conflict of law principles.

Any dispute arising from these Terms or your use of the App shall be resolved through:

• First, good faith negotiation—Contact us at support@bestdailyapp.com to attempt resolution
• If unresolved—Binding arbitration in Dallas County, Texas, under the rules of the American Arbitration Association
• Class action waiver—You agree to resolve disputes individually, not as part of a class action

This section does not apply to small claims court actions or to claims for injunctive relief related to intellectual property.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Compromiso regarding the use of Best Daily and supersede any prior agreements.
